Terms of Service

1. Acceptance of Terms

By accessing or using PlateShotAI ("the Service"), operated by PlateShotAI ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Service.

2. Description of Service

PlateShotAI is an AI-powered product photography enhancement platform. You upload product images and our system uses artificial intelligence models to generate enhanced versions of those images. The Service is provided "as is" — enhanced results may vary and are not guaranteed to meet specific quality expectations.

3. AI Processing Disclosure

In accordance with the EU AI Act, we disclose that PlateShotAI uses machine-learning models provided by third-party AI infrastructure (currently Replicate, Inc.) to process and enhance your images. No human reviews your images during the enhancement process. The AI models are classified as low-risk under the EU AI Act.

4. Account Registration

You must create an account to use the Service. Account authentication is provided by Clerk, Inc. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and be at least 16 years of age.

5. User Content

You retain all ownership rights to images you upload ("User Content"). By uploading images, you grant us a limited, non-exclusive license to process, store, and transmit your images solely for the purpose of providing the Service. We do not use your images to train AI models. We do not claim ownership of your content or the enhanced results.

You represent and warrant that you have the right to upload the images you submit and that your content does not infringe any third-party rights.

6. Prohibited Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, or violates any applicable law
• Process images you do not have the right to use
• Attempt to reverse-engineer, extract, or replicate the AI models
• Circumvent usage limits or access controls
• Use the Service to generate misleading or deceptive content

7. Payment Terms

Certain features of the Service may require payment. Payments are processed by Stripe, Inc. All prices displayed to users in the European Union include applicable VAT. You agree to pay all fees associated with your use of paid features.

Right of withdrawal (EU users): Under EU consumer protection law, you have a 14-day right of withdrawal from the date of purchase. However, by initiating image processing (using credits), you expressly consent to the immediate performance of the service and acknowledge that you lose your right of withdrawal for credits already consumed. Unused credits remain eligible for withdrawal within the 14-day period.

8. Intellectual Property

The Service, including its design, code, logos, and branding, is owned by PlateShotAI and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding.

9. Service Availability and Modifications

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We will make reasonable efforts to notify users of significant changes. We do not guarantee uninterrupted or error-free operation of the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PlateShotAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, death, or personal injury caused by negligence, or any mandatory consumer protection rights under EU law.

11. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which PlateShotAI is established. For users in the European Union, mandatory consumer protection laws of your country of residence apply where they provide greater protection.

EU residents may submit complaints to the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or an in-app notice at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
